These Terms and Conditions govern your access to and use of
Fieyie’s mobile application, website, and related services. By creating an
account, booking a service, or otherwise using Fieyie, you agree to these
Terms.
1. Definitions
- “Fieyie,”
“we,” “us,” “our” means the Fieyie platform operated from Dansoman,
Accra, Ghana.
- “Platform”
means the Fieyie app, website, and related channels.
- “Customer”
means a user who requests or receives services via the Platform.
- “Service
Provider” or “Provider” means an independent contractor or business
that offers services via the Platform.
- “Services”
means the handy or on-site services requested by Customers and performed
by Providers.
2. Nature of the Platform
Fieyie is a technology platform that connects Customers with
independent Service Providers. Providers are not employees, agents, or
representatives of Fieyie. Except where we state otherwise in writing, Fieyie
does not perform the Services and does not supervise or control Providers. Each
Provider is solely responsible for the quality, safety, legality, and delivery
of their Services.
3. Eligibility and Accounts
- You
must be at least 18 years old and able to form a binding contract to use
the Platform.
- You
are responsible for maintaining the confidentiality of your login
credentials and for all activities under your account.
- You
agree to provide accurate, current, and complete information and to keep
it updated.
4. Booking and Availability
- All
bookings are subject to Provider availability and acceptance.
- A
booking is confirmed when you receive an in-app or email confirmation.
- Fieyie
or the Provider may decline, reschedule, or cancel a booking for reasons
including safety concerns, inaccurate details, unavailability, or
circumstances beyond reasonable control. Where possible, prior notice will
be given and alternatives may be offered.
5. Service Description and Customer Obligations
- Customers
must provide accurate job details, access instructions, and any hazards or
restrictions at the service location.
- Customers
must ensure the work area is safe, accessible, and compliant with
applicable laws and building rules.
- Customers
agree not to request any illegal or unsafe work. Providers may refuse work
that is unsafe, unlawful, or materially different from the booking
description.
6. Provider Standards
- Providers
are responsible for supplying tools, materials, and skills to complete the
job unless otherwise stated in the booking.
- Providers
are encouraged to hold appropriate qualifications, permits, and insurance
for the Services they offer.
- Where
background or identity checks are performed, they are conducted subject to
local law. Fieyie does not guarantee the outcome of any screening.
7. Pricing, Payments, and Invoicing
- Prices
may be shown as fixed, hourly, or estimated. For hourly or estimated jobs,
the final price may vary based on actual time and scope.
- Unless
stated otherwise, payments are due upon completion of the Service. Some
bookings may require an upfront deposit or pre-authorization.
- You
authorize Fieyie and our payment partners to charge your selected payment
method for amounts due, including base fees, materials, taxes, surcharges,
and applicable cancellation or no-show fees.
- Fieyie
may issue invoices or receipts on behalf of Providers. Customers are
responsible for verifying invoice details and notifying us promptly of any
discrepancies.
8. Cancellations, Rescheduling, No-shows, and Wait Time
- Customer
cancellations: At least 24 hours’ notice is required. Cancellations
within 24 hours may incur a cancellation fee up to a reasonable portion of
the quoted amount or a fixed fee notified on the Platform.
- Rescheduling:
Subject to Provider availability. Late reschedules may be treated as
cancellations.
- No-shows
and access issues: If a Provider arrives and cannot access the
location or the Customer is not present after a reasonable wait time, a
no-show fee or call-out fee may apply.
- Provider
cancellations: If a Provider cancels, you may reschedule with the same
or a different Provider or request a refund of any prepayment.
9. Refunds, Disputes, and Service Quality
- We
aim for high service standards, but results may vary based on site
conditions and scope.
- Report
any service issues to Fieyie at hello@fieyie.com within 7 days of
completion with clear details and evidence.
- Where
appropriate, remedies may include rework, a partial refund, or a credit,
determined case by case with the Provider.
- Fieyie
is not required to provide a refund where the issue arises from inaccurate
job descriptions, inaccessible sites, change in scope, or
Customer-provided materials.
10. Safety
- Customers
must disclose hazards, sensitive equipment, or special instructions before
the booking.
- Providers
must comply with reasonable safety practices and applicable laws.
- Either
party may stop work if a safety risk is identified. Fees may still apply
for time spent and materials used up to that point.
11. Prohibited Activities
Users must not:
- Use
the Platform for unlawful purposes or to violate applicable regulations.
- Harass,
intimidate, or abuse others.
- Circumvent
the Platform to avoid paying fees due to Fieyie or a Provider for Services
arranged through the Platform.
- Post
false, misleading, or defamatory content.
- Interfere
with or disrupt the Platform’s operation, including attempting to gain
unauthorized access.
12. Reviews and Ratings
- Customers
may submit reviews and ratings. By posting, you grant Fieyie a
non-exclusive, royalty-free license to use and display that content in
connection with the Platform.
- Reviews
must be fair and lawful. Fieyie may remove content that is abusive,
deceptive, or violates rights, without obligation.
13. Intellectual Property
- The
Platform, including its design, software, and content, is owned by or
licensed to Fieyie and is protected by law.
- You
may use the Platform for personal or internal business purposes. You may
not copy, modify, distribute, or reverse engineer any part of the Platform
except as permitted by law.
14. Privacy
Your use of the Platform is also governed by the Fieyie
Privacy Policy. By using Fieyie, you acknowledge that we will process your
personal information as described there and in accordance with the Data
Protection Act, 2012 (Act 843) and other applicable laws.
15. Taxes and Legal Compliance
- Providers
are responsible for their own taxes, permits, and compliance obligations.
- Customers
are responsible for any taxes that apply to the Services they purchase
when such taxes are not collected by Fieyie.
16. Warranty Disclaimer
To the fullest extent permitted by law, the Platform and all
Services are provided “as is” and “as available.” Fieyie does not warrant that
the Platform will be uninterrupted or error-free, or that any Service will meet
your expectations beyond what the Provider has committed to perform.
17. Limitation of Liability
- To
the maximum extent permitted by law, Fieyie is not liable for indirect,
incidental, special, consequential, or punitive damages, or loss of
profits, revenue, data, or goodwill arising from or related to your use of
the Platform or Services.
- In
all cases, Fieyie’s total liability for any claim shall not exceed the
amount you paid via the Platform for the Service giving rise to the claim.
18. Indemnity
You agree to defend, indemnify, and hold harmless Fieyie,
its affiliates, directors, and staff from any claims, damages, liabilities, and
expenses arising out of or related to:
- Your
use of the Platform or Services;
- Your
breach of these Terms;
- Any
violation of laws or third-party rights by you or anyone using your
account.
19. Force Majeure
Neither Fieyie nor the Provider is liable for delays or
failures caused by events beyond reasonable control, including acts of God,
government actions, strikes, utility failures, or extreme weather. In such
cases, appointments may be rescheduled or cancelled without liability.
20. Suspension and Termination
We may suspend or terminate your access to the Platform with
or without notice if you violate these Terms or if your conduct creates risk or
possible legal exposure for us or other users. You may stop using the Platform
at any time.
21. Changes to These Terms
We may modify these Terms from time to time. The updated
version will be effective when posted with a revised “Last updated” date.
Continued use of the Platform after changes become effective constitutes
acceptance of the updated Terms.
22. Governing Law and Dispute Resolution
- These
Terms are governed by the laws of the Republic of Ghana.
- Parties
will first attempt to resolve disputes through good-faith negotiations
within 30 days of written notice.
- If
not resolved, the dispute may be referred to mediation in Accra. If
mediation fails, either party may bring the matter before the competent
courts in Accra, Ghana.
23. Communications
You consent to receive transactional communications related
to your bookings and account. You may opt out of marketing messages at any
time. Notices may be provided via email, in-app messages, or postings on the
Platform.
24. Assignment
You may not assign or transfer your rights or obligations
under these Terms without our prior written consent. We may assign these Terms
in connection with a merger, acquisition, or sale of assets.
25. Miscellaneous
- Severability:
If a provision is found unenforceable, the remaining provisions remain in
effect.
- No
waiver: Failure to enforce any provision is not a waiver of our
rights.
- Entire
agreement: These Terms, together with the Privacy Policy and any
service-specific terms, make up the entire agreement between you and
Fieyie regarding the Platform and Services.
